3. Required Information for a DMCA Notice
A valid copyright infringement notification should comply with the requirements of 17 U.S.C. § 512(c)(3) and include the following information.

Include a statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

5. Review of DMCA Notices
After receiving a sufficiently complete DMCA notice, Avitance may:
- Confirm receipt of the notice;
- Review the identified material;
- Verify that the notice contains the required information;
- Request clarification or additional information where reasonably necessary;
- Restrict access to the reported material;
- Remove the reported material;
- Contact the party responsible for the content, where applicable; or
- Take another action appropriate under applicable law.
Submission of a notice does not automatically establish that copyright infringement has occurred.
6. Incomplete Notices
A notice that does not contain sufficient information may not allow Avitance to properly identify or evaluate the claim.
If information is missing, we may request additional details before taking further action.

7. Misrepresentation and False Claims
Copyright notices must be submitted in good faith.
Do not knowingly submit false, fraudulent, or materially misleading claims.
Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material or activity is infringing may be liable for damages, including certain costs and attorneys' fees.
Before submitting a notice, the claimant should consider whether the disputed use may be authorized, licensed, permitted by law, or subject to an applicable limitation or exception.
8. Removal or Restriction of Material
If a sufficiently supported claim is received and removal or restriction is appropriate, Avitance may remove or disable access to the identified material.
Where appropriate, we may notify the party associated with the affected material.

A counter-notification should comply with 17 U.S.C. § 512(g)(3) and include:

E. Consent to Jurisdiction

12. Processing a Counter-Notification
After receiving a valid counter-notification, Avitance may forward it to the party who submitted the original copyright complaint.
Subject to applicable law, material may be restored after the required statutory period unless the original claimant informs us that appropriate legal action has been filed seeking a court order against the party who submitted the counter-notification.
Restoration is subject to applicable legal requirements and the circumstances of the case.
13. Repeat Infringement
Where appropriate and consistent with applicable law, Avitance may restrict or terminate access or relationships involving parties who repeatedly engage in copyright infringement.
Any action will depend on the circumstances and available evidence.
14. Copyright Ownership Disputes
Avitance is not a court and generally cannot adjudicate complex disputes regarding copyright ownership, licensing, authorship, or contractual rights between third parties.
Where competing parties present conflicting claims that cannot reasonably be resolved through the notice process, the parties may need to resolve the dispute through appropriate legal channels.
15. Third-Party Content
Avitance may use materials provided by suppliers, technology providers, service providers, licensors, or other third parties.
If a complaint concerns third-party material, we may contact the relevant party or request supporting information regarding authorization or licensing.
